1. General

The “submit an innovation” module available on the MTN BENIN website www.mtn.bj, allows any natural or legal person with innovative ideas to submit a proposal.

These general terms and conditions have been edited to clarify functioning and the rules that should govern the submission of said proposals.

     2. Target

Any local or foreign company can participate whether it is already in the MTN BENIN supplier base or not.

    3. Application fields

The proposals may be intended for internal use by MTN BENIN (to improve the processes in progress within MTN itself) or for external use (to improve or innovate in relation to the services provided to subscribers).

In a non-exhaustive way, it can concretely be proposals relating to:

  • The modernization and/or digitization of a process;
  • The adoption of new processes allowing a better respect of the environment
  • A new business concept;
  • Any other proposal allowing any gain in time, energy or any other resources.

     4. Procedure

The management of the submissions of innovative proposals will be done in accordance with the following steps:

The company submits its proposal or project online, on the website www.mtn.bj, on the “Submit an innovation” tab.

  •  MTN periodically studies all the proposals received and contacts (only) the suppliers whose proposals have been pre-selected according to the needs of the moment.
  • Discussion sessions are held with the pre-selected supplier about their proposal and the implementation methods. These discussions may or may not result in the award or not of a contract or the signing of a contract.

NB: Authors of selected proposals will be contacted within three (3) months at the most. The other proposals will be archived for future needs.

5. Submission of proposals and/or projects

Proposals can be submitted at any time on the dedicated portal unless decided otherwise by MTN BENIN.

In this case, the information will be shared on all the channels that MTN deems required. Companies will then only be able to submit their proposals within the time limit and following the process thus defined.

6. Obligations of platform users

6.1 Use of the platform

The user is required to use the platform in accordance with these general conditions and the legal provisions in force.

As such, the user is prohibited from any impediment to the operation that would prevent or limit, in any way whatsoever, access or its use by third parties under penalty of being denied access to the said platform without notice.

The user is solely responsible for the use of the information of which he is the source, for the consequences of the decisions he may be called upon to make and resulting from the use of the platform and guarantees MTN BENIN against any action and/ or claims of third parties in this regard.

Further, User agrees not to use any data mining, robots, or any other method of data extraction or data collection or attempt to gain unauthorized access to any or part of the interface through hacking, password mining or otherwise.

      6.2 Warning

As the platform uses the Internet, it is expressly reminded that the Internet is not a secure network. The user therefore acknowledges being fully informed of the lack of reliability of the Internet network, particularly in terms of the lack of security in the context of the transmission of files, information and data of any kind and in terms of the non-guarantee of performance relating to the volume and speed of data transmission. It is up to the user to take all appropriate measures to protect his own data, in particular in the event of contamination by any viruses circulating on the Internet network or the intrusion of a third party into the system of his terminal. (computer, laptop, tablet, smartphone, etc.) for any purpose whatsoever and to make backups before and after the commissioning of the platform.

     7. Personal data

The information provided by the user when using the platform is used in the “Become a supplier” and “Submit an innovation” modules on the mtn.bj site.

MTN BENIN, in its capacity as data controller, takes the appropriate technical and organizational measures to ensure its protection and confidentiality. The processing of the user’s personal data is necessary to satisfy his request and is carried out in accordance with the applicable regulations on the protection of personal data.

Each user may at any time exercise their rights of access, rectification, erasure, deletion, opposition, limitation to processing and portability of the data concerning them by writing to the General Management of MTN located at 360 Boulevard de la Marina with mention of the object and justifying its identity.

The user, by accepting these general conditions, authorizes MTN BENIN to collect his personal information and to process it in accordance with the purpose for which it is intended.

The data will be kept for a period of twenty-four (24) months after the termination of the relationship between the two parties.

The user is fully responsible for the use and retention of his personal data and, where applicable, for the consequences of their disclosure or use by third parties and is deemed to have authorized it, whether or not it is of its done.

8. Platform Maintenance

MTN BENIN reserves the right to interrupt access to the platform at any time for maintenance and without having to justify it. The responsibility of MTN BENIN cannot be retained, the interruption will therefore not give rise to compensation for the benefit of the subscriber. MTN BENIN will endeavor in this case to warn subscribers beforehand by any means leaving a written record in the event of an interruption for maintenance, MTN BENIN will endeavor to inform the subscriber beforehand and to schedule said interruptions for maintenance. days and/or times likely to cause the least inconvenience for the subscriber.

      9. Confidentiality

MTN BENIN through its site will protect confidential data and information received from companies and will treat them in a strictly confidential manner. Under these terms and conditions of this agreement, confidential information constitutes, for document, any information that the user may be required to share on this platform, including the project and the proposal made within the framework of the “submit an innovation” module.

MTN BENIN undertakes to keep them secret and confidential, and to refrain from communicating them to any third party, except to use them, themselves, only within the framework referred to above.

    10. Intellectual Property

All content, logos, gifs and icons under the “MTN” banner as well as their formatting are the exclusive property of MTN BENIN.

Any reproduction, distribution, modification, adaptation, retransmission or publication, even partial, of these various elements is strictly prohibited without the express written consent of MTN BENIN.

The content, logos, gifs and icons as well as trademarks, service marks, trade names and design rights, whether registered or not, of any company and or company having access to this platform remain its exclusive property. For the avoidance of doubt, no provision of these general conditions constitutes or should be interpreted as an assignment of all or part of the intellectual property of MTN BENIN or of the companies or companies submitting bids having access to this platform.

Each Party remains the sole holder of the rights relating to the confidential information communicated to the other. No DPI (Brand, Logo, Commercial Name, Patent or Process) or use of any kind whatsoever is granted by one Party to the other due to the communication of confidential information.

The parties each retain exclusive ownership of their brand. Neither party may rely on or use the trademark of the other without its prior written consent.

     11. Responsibility

MTN BENIN is bound by an obligation of means. Consequently, MTN BENIN declines all responsibility for the technical difficulties that the user may encounter in the context of the use of the service, whatever the cause, the origin, in particular in the occurrence of “bugs”, failure to respect the integrity of information through communication networks, lack of capacity, connection or security of the terminal.

In this respect, the service is made available to the user as is and the user bears all the risks in terms of quality and performance of the interface, in particular no guarantee of any kind whatsoever, implicit or express is granted by MTN BENIN regarding the ability of the service to fulfill a particular use, its absence of technical error or interruption. MTN BENIN incurs no liability for direct, indirect, incidental or aggravated incidents such as, in particular, loss of data or loss related to business interruption or resulting from the use or inability to use of the service even if MTN BENIN has been informed of the possibility of occurrence of such damages.

      12. Applicable law and dispute resolution

The use of the interface and the conditions of use are governed by Beninese law.

Any dispute related to the use of the interface and/or the conditions of use that cannot be settled amicably between MTN BENIN and the user will be subject to the assessment of the competent Beninese courts.
